Important safety and liability notice: EVcando cannot inspect the vehicle or repair site. Materials and AI answers may be incorrect, omit warnings or be inapplicable to the vehicle. Even following an answer exactly may cause death, personal injury, fire, electric shock, or damage to vehicles or other property. Users must independently verify information, decide for themselves whether to act and bear the associated risks of use. Section 12 of this Statement expressly sets out accident liability exclusions and applies together with the indemnification and liability limits in Sections 13 and 14 of the User Agreement.
1. Scope and Contractual Relationship
This Statement applies to repair conversations, diagnostic materials, repair manuals, wiring diagrams, material cards, AI explanations, inferences, general advice and related historical content provided by EVcando. It forms part of the User Agreement by reference. “We” and “the platform” refer to PENTACREST TECHNOLOGY LIMITED.
This Statement directly addresses safety verification, repair responsibility and accident liability exclusions. User indemnification, excluded losses, the aggregate liability cap, common exceptions and dispute resolution are governed by Sections 13, 14 and 17 of the User Agreement, respectively. This Statement does not create a separate or increased liability cap. All provisions concerning use at the user’s own risk, allocation of responsibility and exclusions of liability are subject to Section 14.7 of the User Agreement.
2. Product Role
EVcando is a tool for repair information retrieval, organization and AI-assisted analysis. It is not a repair technician, on-site engineer, manufacturer technical representative, inspection body, insurer, roadside-assistance provider or emergency service.
We do not possess the vehicle or carry out removal, installation, measurement, programming, charging, discharging, lifting, road testing or vehicle handover. We do not know every modification, defect, repair history or on-site condition.
The platform may provide step-by-step reference information, but the services do not constitute on-site diagnosis, approval of a repair procedure for a particular vehicle, safety certification, compliance certification or confirmation of roadworthiness.
Conversational wording, step-by-step instructions or directions that appear to call for continued action do not mean that EVcando has inspected the vehicle, verified prerequisites or authorized an operation. Before acting, users must fulfill the verification and stop-work requirements in this Statement.
The services are primarily intended for professional repair settings, but individual vehicle owners are not prohibited from using them. Individual owners and inexperienced users must not treat access to the services as evidence that they are qualified to carry out repairs.
3. Nature of Information
The services may contain the following types of information. Users must distinguish them according to their labels.
3.1 Original Repair Materials
These are displayed programmatically from released materials, with a title, position in the contents or source. Source labels indicate only the classification or stated source of materials. They do not guarantee that the materials are current, complete, error-free or applicable to the user’s vehicle.
3.2 User-Supplied On-Site Information or Judgments
These include measurement data, symptoms, completed tasks and judgments such as “normal” or “abnormal” supplied by users. Users are responsible for this information. It is neither a manufacturer conclusion nor a result verified by the platform.
Step records, selected answers or completion statuses in conversations record information provided or processed within the services. They are not independent evidence that actual tests were correctly performed or that a vehicle passed them.
3.3 AI Inferences Based on Materials
These are generated by AI using one or more provided materials. Inferences may assist comparison and explanation, but are not original source materials or confirmation of a fault’s cause.
3.4 General AI Repair Advice
This is based on general repair knowledge or experience and may lack direct support from currently available materials. Without supporting materials, vehicle-specific torque values, terminals, wiring, specifications, software or operating procedures must not be treated as confirmed.
3.5 Public Internet Materials
This category applies only if the product integrates and clearly identifies such materials in the future. A source link does not imply our endorsement or make the content original repair materials.
4. Limitations of AI and Materials
AI outputs may be incorrect, incomplete, outdated, based on misunderstandings, confused between vehicle models, contain unit-conversion errors, omit prerequisites or be inapplicable to the actual conditions.
Even coherent, complete, professionally worded answers or answers with page numbers and references may contain significant errors.
Original materials themselves may have missing pages, typographical errors, outdated content, internal inconsistencies, regional differences or later manufacturer revisions.
Summarization, translation, optical character recognition, format conversion and AI explanations may introduce new errors. Translations must not replace authoritative original materials.
The same fault code may correspond to different systems, configurations or diagnostic pages. If the wrong vehicle, market, production date, configuration or primary material is selected, all subsequent content may be inapplicable.
Historical records reflect materials and service status at the time of creation. Viewing history again does not mean that the content remains current.
Repeatedly consistent AI answers do not constitute independent corroboration. Applicability must be verified again when an answer is used for another vehicle, configuration or site. Even within the same conversation, changes in vehicle condition may invalidate earlier conclusions.
The absence of a displayed warning, fault, recall or risk does not mean that it does not exist or that an operation is safe.
The services cannot sense whether a vehicle is powered down, whether residual high voltage remains, connector condition, lifting points, support stability, ventilation, personnel location or tool condition.
5. User Verification Before Operations
Before performing any operation, users must independently:
- verify the vehicle identification number, model year, production date, sales market, powertrain, optional equipment, software version and modifications;
- obtain and consult the latest manufacturer repair materials, technical bulletins, recalls and regulatory requirements applicable to that vehicle;
- verify fault-code interpretations, material titles, positions in the contents and the selected primary diagnostic page;
- verify what is being measured, measurement ranges, units, terminals, polarity, torque, temperature, capacity, part numbers and tool requirements;
- inspect the actual vehicle condition, working environment, personal protective equipment, insulation, fire protection, ventilation, lifting, support and isolation conditions;
- assess whether they have the necessary training, qualifications, authorization, experience and insurance;
- resolve conflicts between materials, between materials and the vehicle, or within an answer;
- stop operations and seek assistance from qualified professionals or the manufacturer if anything is uncertain, conditions are insufficient or verification is not possible.
Users must not omit these checks merely because “the platform provided steps”, “the platform displayed manufacturer materials” or “the answer had no warning”.
6. High-Risk Systems and Operations
The following may cause death, personal injury, fire, electric shock, thermal runaway, loss of vehicle control or significant property damage. They must be handled by appropriately qualified and equipped personnel in accordance with applicable law and manufacturer procedures:
- high-voltage systems, traction batteries, charging and discharging, insulation testing and high-voltage interlocks;
- battery removal, installation, transport, storage, repair and thermal-runaway response;
- lifting, support, work beneath vehicles, road testing and dynamometer testing;
- brakes, steering, tires, suspension, drivetrains and safety-critical fasteners;
- airbags, pretensioners and other pyrotechnic restraint systems;
- vehicle programming, calibration, anti-theft systems, advanced driver-assistance system calibration and controller replacement;
- fuel, refrigerants, compressed gases, welding, cutting and work that may create sparks;
- vehicles involving damage, water ingress, collision, smoke, unusual odors, abnormal heating or unidentified modifications.
The services cannot list every hazard and prerequisite for these operations. No single answer may be treated as a complete safe-work procedure.
7. When Work Must Stop
Users must immediately stop the relevant operation, take protective measures within their ability and seek qualified assistance when:
- vehicle identity, material applicability or fault-code interpretation cannot be confirmed;
- answers, materials, measurements or on-site observations conflict;
- manufacturer-required tools, personal protective equipment, training, authorization or a safe environment are missing;
- high voltage is not reliably isolated, or there are insulation abnormalities, smoke, unusual odors, leaks, abnormal temperature rises, sparks, structural damage or signs of thermal runaway;
- the operation may endanger people inside or near the vehicle, public roads or nearby property;
- the user cannot understand a step, decision condition, unit or possible consequence;
- applicable law, manufacturer procedures or workplace rules require escalation.
In immediate danger, users must prioritize evacuation, contact local emergency services and follow emergency procedures from the manufacturer and competent authorities. They must not wait for a platform response.
8. User Decisions, Use at Own Risk and Repair Consequences
Users use or rely on Platform Materials, AI answers and support information at their own risk. Users must not treat this content as the sole factual basis or a substitute for manufacturer procedures, necessary on-site inspections and qualified professional judgment.
Users control, or are responsible for confirming, the vehicle, tools, premises and workflow. Users independently decide whether, when and how to use information and are responsible for inspection sequences, skipped steps, interpretation of measurements, parts selection, removal, installation, programming, repair quality, testing, road testing and vehicle handover.
Services and representations users provide to vehicle owners, customers, employers, passengers or insurers are their own conduct. Users must not claim that the platform, AI or materials approve, supervise, certify or guarantee repair results. We do not insure users’ repair work or assume their obligations to third parties.
Users bear the risks and legally applicable responsibility arising from departures from manufacturer procedures, skipped safety steps, inaccurate or incomplete on-site information, or action based on unverified information.
Even following a platform answer or displayed procedure exactly does not replace independent verification. Users cannot transfer responsibility for repair decisions, on-site operations or accidents to the platform merely by saying they “followed the answer”. Users must assess whether a procedure is appropriate, complete and safe for the actual vehicle and site. If they cannot make that assessment, they must not perform it. Detailed answers, citations to manufacturer materials and previous successful use do not change this requirement.
Providing warnings, sources or suggestions does not mean that the platform takes over users’ professional judgment. We have no duty to continuously monitor, supervise the site or approve the next step. Platform silence, delayed replies, missing warnings or a conversation moving to the next step do not confirm that an operation is safe.
Repair and vehicle use may cause accidents, injury, death, fire, electric shock, thermal runaway, loss of vehicle control, damage to vehicles, batteries or other property, and third-party claims. Section 12 governs accident risks and the allocation of responsibility.
9. Vehicle Handover and Safety Confirmation
Service content must not be used as:
- proof that repairs are complete;
- confirmation that a high-voltage system is safe;
- certification of brakes, steering or other safety systems;
- proof of statutory inspection, compliance or roadworthiness;
- a basis for authorizing a vehicle’s return to the road or handover for use by customers, passengers or the public;
- proof of insurance, warranty coverage or manufacturer approval.
Users must complete independent inspections, tests, records and necessary sign-off under applicable law, industry practice and manufacturer procedures, and make release decisions on that basis. Platform content may serve as an information reference during repairs, but cannot replace those results or prove that the platform has approved a vehicle’s safety or return to the road.
10. Reporting Problems Does Not Transfer Responsibility
Users may report errors through “Report a problem with this answer” or support channels. Reports help us investigate and improve the services, but do not mean that we can review or correct answers in real time before users act. While awaiting a reply, users must continue to avoid operations whose safety they cannot confirm.
Acknowledging a report, starting an investigation or providing a correction does not certify prior work, approve continued operations or guarantee a response before the vehicle is used. Users must assess whether earlier operations need independent reinspection.
11. First-Use Safety Acknowledgment
Before first using repair conversations, users must read and accept this Statement and expressly acknowledge the following:
I understand that EVcando provides repair materials and AI-assisted information and may provide step-by-step references, but does not inspect the site or approve, supervise or certify actual repairs. Materials and answers may be incorrect, incomplete, omit warnings or be inapplicable to the vehicle. Before use, I will independently verify the vehicle, source materials, measurement data and safety conditions. I will not use answers as the sole basis for repairs or a substitute for necessary professional judgment, or as a basis for authorizing a vehicle’s return to the road or handover for use. I will act only when I have the required ability, qualifications and equipment. For high voltage, batteries, lifting, brakes, steering, airbags or other high-risk matters, I will follow applicable manufacturer procedures, stop work when I cannot confirm safety and seek qualified assistance. I understand that even following an answer may result in death, injury, fire or damage to vehicles or other property. I decide for myself how to use information and bear the associated risks of use. I have read and accept the accident liability exclusions, indemnification, liability limits and common exceptions in Section 12 of this Statement and Sections 13 and 14 of the User Agreement.
Users who do not make that acknowledgment, or do not accept those safety requirements and liability terms, must not use repair conversations. Accepting the User Agreement at registration does not replace express acknowledgment of the safety matters in this section. First-use acknowledgment does not replace checks before each operation; the relevant duties continue to apply.
12. Disclaimers, Accident Liability Exclusions and Claims
12.1 No Guarantee of Accuracy, Safety or Repair Results
The services, materials, AI answers and related support information are provided “as is” and “as available”. To the fullest extent permitted by applicable law, we and the protected parties described in Section 15 of the User Agreement do not guarantee their accuracy, completeness, timeliness, freedom from error or suitability for a particular vehicle or purpose. Nor do we guarantee identification of all faults, hazards, recalls and prerequisites, provision of all necessary warnings or prevention of accidents. We do not guarantee successful repairs, vehicle safety, cost savings or any particular result. This section applies together with Section 12 of the User Agreement and does not negate express commitments in that Agreement or applicable purchase terms.
12.2 Accidents Arising from Use or Reliance
To the fullest extent permitted by applicable law, and subject to the common exceptions in Section 14.7 of the User Agreement, we and the protected parties described in Section 15 of that Agreement are not liable for repair results, death, personal injury, fire, electric shock, thermal runaway, loss of vehicle control or damage to vehicles, traction batteries, charging equipment, components, tools, premises or other property arising from a user’s use of or reliance on the services, Platform Materials, AI answers or support communications.
This exclusion includes errors, omissions, incorrect parameters, inappropriate procedures, outdated content, vehicle-model or market mismatches and missing warnings in materials or answers, as well as cases where users follow an answer or displayed procedure exactly. Detailed or confident answers, sources and previous successful use do not guarantee accuracy or safety. Displaying steps, accepting user judgments, recording completion status or moving a conversation to the next step does not constitute on-site verification or approval.
Use of the services before an accident does not itself establish our liability for that accident. Our failure to promptly identify, report or correct a risk does not mean that we have promised continuous supervision of vehicles, sites or historical answers. Users must still fulfill the verification, stop-work, reinspection and independent-release duties in this Statement.
12.3 Excluded Losses, Indemnification and Aggregate Cap
Indirect, incidental, special, punitive, exemplary and consequential losses, and losses such as rework, towing, replacement vehicles, downtime, business or data losses, recall and insurance costs and related third-party claims, are governed uniformly by the exclusions and limits in Section 14 of the User Agreement. Those limits apply to the extent permitted by law even if we were advised of the possibility of loss.
Any liability nevertheless found to be ours is subject to the aggregate monetary cap, aggregation of related claims, legal bases of claims and limits on remedies in that section. Repetition of risk notices in this Statement does not create an additional liability cap. Claims and remediation costs arising from users’ repair activities, prohibited use, false certification representations or unauthorized submission of third-party information are subject to the indemnification and defense obligations in Section 13 of the User Agreement.
12.4 Common Exceptions
This Statement does not exclude or limit liability that cannot lawfully be excluded or limited, including, where applicable, death or personal injury caused by our own negligence or that of a party invoking these protections, fraud, willful misconduct and non-excludable consumer rights, as detailed in Section 14.7 of the User Agreement. Accepting safety notices does not transfer to users liability that cannot lawfully be transferred. Each exclusion and limitation applies independently; the inapplicability of one does not affect other valid provisions.
Updates, continuing effect, Hong Kong law and the exclusive jurisdiction of Hong Kong courts are governed by the User Agreement. If language versions are ambiguous or inconsistent, the English version prevails, without reducing rights that cannot lawfully be excluded. Safety issues and related notices: contact@evcando.com.
